Do you live in a building with neighbors and don’t know if it’s possible?

So, the first thing you should know is that any owner can request the installation in their community of residents.

What is the process? Which are the legal requirements? Do all the neighbors have to agree?

What is collective self-consumption?

It is estimated that, in Spain, 66.5% of the population lives in residential buildings. But this is not a problem for the installation of solar panels.

In these cases, it would be collective self-consumption, since all residents can take advantage of the energy generated by a single installation.

What legal requirements must my community of residents meet?

These reforms entail an alteration of a common element, as established in Article 396 of the Civil Code and Article 17.1 of the Horizontal Property Law. However, if you comply with these regulations, you will not have any problems carrying out the work.

Can solar panels be installed in any community of residents?

Yes, but not all communities have the space or the necessary conditions for their installation. In summary, these are the 3 types of rooftops where installation is allowed:

– Rooftops of residential buildings: if there are no problems with space or orientation, the installation is carried out in the same block of the community.

– Rooftops of adjoining buildings: the law allows this (by agreement) in buildings up to a radius of 500 meters.

– By cadastral reference: Sharing, at least, 14 digits of the cadastral reference of the building of another.

What kind of agreement should be reached with the neighbors?

The neighbors must agree on the following points:

– Agreement to use a community space for the installation of solar panels.

– Economic participation agreement.

– Agreement on the sharing of the energy generated.

Does it require the agreement of all Neighbors?

The favorable vote of one third of the owners is sufficient, which must also represent one third of the participation quotas. Neighbors who are not interested are not obliged to participate.

It must also be guaranteed that the annual cost (discounting subsidies or public aid) does not exceed twelve ordinary monthly payments of common expenses, as indicated in the Horizontal Property Law.

What happens if in the future the neighbors who were not satisfied also want to benefit from the installation of self-consumption?

They will be able to join, but they will also have to pay the proportional part of the installation.

Is a building permit required?

It depends on the autonomous community. In the case of Andalusia, the Balearic Islands, Catalonia or Extremadura it is not necessary, but in many others it is. To clear up any doubts, it is advisable to consult with your town hall.

Are there subsidies for this reform?

Yes. The conditions to be met according to the Horizontal Property Law are:

– That the cost of the installation (discounting the subsidy) does not exceed twelve ordinary monthly payments of common expenses.

– Start the works when public aid covers 75% of the amount of these.

How is the energy generated distributed?

The installation company will evaluate the individual consumption to size the installation and make a correct distribution.

The community will decide whether to approve the company’s proposal. The costs of the installation can be proportional to the power contracted by each owner, the number of inhabitants or other factors decided by the community.

It is always recommended that the agreement to be reached be written down.
